CUCKOOBAG Terms & Conditions

Our sales are subject to these terms and conditions which override any customer or third party terms or conditions.

Orders can only be cancelled or varied by a customer if production has not begun and subject to the customer paying 30% of the order placed and reimbursing us for any costs incurred due to cancellation/variation.

It is the customers responsibility to check all proofs/artwork (including accuracy and layout)/specifications and for approving such items within the time frames required by us to meet production/delivery deadlines.

Where the customer uses third party agencies it is implied that such agencies have full authority to deal with us directly and to give approvals and to bind the customer.

The customer guarantees that fulfillment of the order will not infringe any intellectual property rights (including copyright) and will indemnify Cuckoobag and our agents against all costs and expenses incurred in any such infringement.

Artwork /printing plates supplied by us remain our property unless paid for in full. Customers requesting the return of artwork/printing plates will be charged the difference between the contribution paid as invoiced and the total cost of artwork/plates plus an appropriate fee to cover administration/storage/carriage.

Customer property is supplied by or on behalf of the customer at the customer's risk and we cannot be held liable for its loss or damage.

Many of our products are hand crafted items so colours, sizes and textures are subject to reasonable variations. Actual quantity delivered will be quantity invoiced.
Every effort will be made to supply products of the quality of samples submitted/quoted for but exact matches to samples or previous orders cannot be guaranteed.

Prices are quoted ex VAT and any applicable government levy which the customer will be charged.

We reserve the right to vary our prices before or after acceptance to meet:
any additional costs resulting from customer variations to orders/ customers requiring expedited delivery/ failing to advise delivery requirements /delay in approving proofs/specifications  any rise in costs of production/materials/shipping.

Our terms are payment are....deposit to secure an order. Should an order be secured in this way and then the production line become compromised this deposit will be refunded in full within 2 months of the product being withdrawn from sale. The final payment is due within...................days of delivery.
Payments to be made by Bank Transfer.. Most debit/credit cards are accepted subject to a 2% charge.

With late payment, we reserve the right to:
charge interest at a rate of 8% from the due date and recover court fees and reasonable costs
take payment without prior notice from a debit/credit card given at time of order or previous orders plus 2.5% charge

With installment deliveries, we are entitled to invoice each installment on delivery and payment is due not withstanding non-delivery of other installments. Default by the customer in paying installments will cause the whole balance of the order to be payable.

Delivery times are approximate and start from approval of proofs and all order details. We reserve the right to deliver in installments if it is more practical to do so and failure to deliver one installment does not give rise to a right to reject other deliveries.

The customer is responsible for:
giving clear delivery instructions for taking delivery (times and restrictions)/unloading as required by health and safety/carriers (failure to do so may result in extra charges)
checking goods on delivery for quantities/damage and signing for them as damaged or not checked by customer if it is impractical to check them
notifying us immediately of any non-delivery or obvious shortfall/damage on delivery.

We will not be liable for the acts or omissions of any couriers/carriers. (The contracted job of all carriers is only to deliver to the door and they cannot leave their vehicle unattended).

Risk on all goods passes to the customer upon delivery.

With non-branded/non-personalised goods, title to the goods will not pass until the agreed percentage deposit payment has been received.

Complaints with the goods delivered will not be entertained unless:
notified to us in accordance with section re couriers above and for other claims, in writing within 14 days of delivery
goods are signed for as damaged/shortfall or, if not checked, as condition not checked substantiated including by producing damaged/faulty items and allowing our representatives to visit to check such goods

If a claim is validly made and substantiated then we will replace the goods supplied or, at our sole discretion, give a credit towards the price of the goods. The customer must make the goods available for collection if we so require.

Subject to complaints section above and in view of the personalised nature of goods, the customer is not entitled to reject/return goods, and delivery of such goods to us will not be deemed to be acceptance of a claim, and, we will hold the customer liable for the costs of return in addition to other sums due. Rejected goods will be at our disposal as we think fit.

All warranties and conditions implied by statute as to quality and fitness for purpose are excluded to the fullest extent permitted by law and no representation is made in respect of manufacture of goods.

Under no circumstances will we be liable to the customer or any third party for any indirect or consequential loss or damage (whether loss of profit or otherwise) arising from or as a result of our supply, delay in supplying or failure to supply goods or for any other reason whatsoever. Our maximum liability is limited to the price quoted or, if invoiced, invoiced for the particular goods to which the claim relates.

Supplies by us are subject to, and we are not liable for, causes beyond our reasonable control e.g. acts of God, war, inability to secure materials.

English law will apply to all of our sales and the customer agrees to the exclusive jurisdiction of the English courts.

If one part of these Conditions were found to be invalid /unenforceable it will not affect the validity of the rest.

The customer is not entitled to assign the benefit of this supply contract to any third party without our agreement.

Cuckoo Bag’s ethos is driven by its use of eco friendly materials and the cornerstone of our products involves the use of jute. Jute bags are eco friendly, reusable and 100% bio degradable.

Jute is known as the golden fiber of Bangladesh where is grows abundantly because of the right climatic conditions. Jute fiber is harvested from the bark of the Jute plant after it is harvested. The Jute plant has a long life span and if discarded will decompose ensuring that valuable nutrients are replaced in the soil. The bark undergoes various processes, before it is ready for use in manufacture. It’s environmentally friendly and does not produce toxic gases. On combustion the jute fumes are not toxic and produce no residue.

Petrochemical products especially plastic bags have become a menace to the environment. Their indiscriminate use has caused havoc to our ecological balance. Jute is gaining popularity for good cause. It is biodegradable – jute mixes with soil and breaks down. In the process, nutrients are restored to the soil. On combustion, its fumes are non- toxic and produce no residue.

The alternative may not come as cheap as its plastic counterpart, but the price paid will still be cheaper at the cost of saving the environment for our coming generations.

Plastic Bags

Cuckoobag are passionate in wanting everyone to educe the consumption of plastic bags. However this is just the beginning of our response to doing our best for the world that we live in. Plastic bags were banned in Bangladesh on 2002, amongst other countries China and Australia have now followed suite. It is our hope that we may aid them to be banned in The U.K. and beyond. Each year around 13 million bags are handed out in U.K. shops alone, and many are just for single usage.

In some countries massive plastic bag mountains are formed as they clutter our landfill sites. Across the globe they have become a real nuisance on land and sea as they pollute our oceans and kill marine life. Furthermore they maintain our dependency upon foreign crude oil.
Polyethylene plastic bags are most common and their decomposition takes from 700-1000 years, if they decompose at all .Some plastic bags with an accelerated decomposition process, often called biodegradable bags. They contain molecules of vegetable origin which in favorable conditions can be colonised by bacteria and so broken down. However they are not suitable for organic waste sites. The 100% biodegradable plastic bag made from of 100% bacterial degradable material, such as corn, coconut, or rice starch, soya protein, etc, again only successfully decomposes in favorable conditions when the bacteria grows. They are also a far more expensive option hence companies slowness to use them Their production costs also increase the world market prices of food costs.
Jute has none of the problems associated with plastic bags and it is Cuckoobags assertion, along with that of the Bangladeshi government, that the world would be a safer place should it be used where ever possible instead of plastic.

Ethical Sourcing Policy

Cuckoobag take our responsibilities towards suppliers and their workers very seriously. All our production is from Bangladesh. To ensure this consideration we conduct all out business within the spirit of the Ethical Trading Initiative Base Code. For further information about this visit

The ETI Base Code is founded on the conventions of the International Labour Organisation (ILO) and is an internationally recognised code of labour practice.

1. Employment is freely chosen
1.1 There is no forced, bonded or involuntary prison labour.
1.2 Workers are not required to lodge "deposits" or their identity papers with their employer and are free to leave their employer after reasonable notice.

2. Freedom of association and the right to collective bargaining are respected
2.1 Workers, without distinction, have the right to join or form trade unions of their own choosing and to bargain collectively.
2.2 The employer adopts an open attitude towards the activities of trade unions and their organisational activities.
2.3 Workers representatives are not discriminated against and have access to carry out their representative functions in the workplace.
2.4 Where the right to freedom of association and collective bargaining is restricted under law, the employer facilitates, and does not hinder, the development of parallel means for independent and free association and bargaining.

3. Working conditions are safe and hygienic
3.1 A safe and hygienic working environment shall be provided, bearing in mind the prevailing knowledge of the industry and of any specific hazards. Adequate steps shall be taken to prevent accidents and injury to health arising out of, associated with, or occurring in the course of work, by minimising, so far as is reasonably practicable, the causes of hazards inherent in the working environment.
3.2 Workers shall receive regular and recorded health and safety training, and such training shall be repeated for new or reassigned workers.
3.3 Access to clean toilet facilities and to potable water, and, if appropriate, sanitary facilities for food storage shall be provided.
3.4 Accommodation, where provided, shall be clean, safe, and meet the basic needs of the workers.
3.5 The company observing the code shall assign responsibility for health and safety to a senior management representative.

4. Child labour shall not be used
4.1 There shall be no new recruitment of child labour.
4.2 Companies shall develop or participate in and contribute to policies and programmes which provide for the transition of any child found to be performing child labour to enable her or him to attend and remain in quality education until no longer a child; "child" and "child labour" being defined in the appendices.
4.3 Children and young persons under 18 shall not be employed at night or in hazardous conditions.
4.4 These policies and procedures shall conform to the provisions of the relevant ILO standards.

5. Living wages are paid
5.1 Wages and benefits paid for a standard working week meet, at a minimum, national legal standards or industry benchmark standards, whichever is higher. In any event wages should always be enough to meet basic needs and to provide some discretionary income.
5.2 All workers shall be provided with written and understandable Information about their employment conditions in respect to wages before they enter employment and about the particulars of their wages for the pay period concerned each time that they are paid.
5.3 Deductions from wages as a disciplinary measure shall not be permitted nor shall any deductions from wages not provided for by national law be permitted without the expressed permission of the worker concerned. All disciplinary measures should be recorded.

6. Working hours are not excessive
6.1 Working hours comply with national laws and benchmark industry standards, whichever affords greater protection.
6.2 In any event, workers shall not on a regular basis be required to work in excess of 48 hours per week and shall be provided with at least one day off for every 7 day period on average. Overtime shall be voluntary, shall not exceed 12 hours per week, shall not be demanded on a regular basis and shall always be compensated at a premium rate.

7. No discrimination is practised
7.1 There is no discrimination in hiring, compensation, access to training, promotion, termination or retirement based on race, caste, national origin, religion, age, disability, gender, marital status, sexual orientation, union membership or political affiliation.

8. Regular employment is provided
8.1 To every extent possible work performed must be on the basis of recognised employment relationship established through national law and practice.
8.2 Obligations to employees under labour or social security laws and regulations arising from the regular employment relationship shall not be avoided through the use of labour-only contracting, sub- contracting, or home-working arrangements, or through apprenticeship schemes where there is no real intent to impart skills or provide regular employment, nor shall any such obligations be avoided through the excessive use of fixed-term contracts of employment.

9. No harsh or inhumane treatment is allowed
9.1 Physical abuse or discipline, the threat of physical abuse, sexual or other harassment and verbal abuse or other forms of intimidation shall be prohibited.Guidance and resources

For Millions Campaign

We have chosen to support the ‘For Millions Campaign’ with respect to enhancing the situations of all workers involved in our production in Bangladesh and our company in the UK. As a result our products are not covered by the Fairtrade Foundation because we maintain our responsibility directly rather than through a third party organization. However our company is considered fairly traded and we have received much support from the ground roots of the organization as we have established ourselves.
Passionate about protecting not only our natural environment, but the living conditions and working environment of people all over the world, Cuckoobag are committed to manufacturing products in a fair and benign working environment. Most of the current production is carried out in Bangladesh. Some of the products are made in factories others by people working in their villages. Cuckoobag has chosen these production routes in order to be able to offer reasonable conditions of work to people that ensure that their standards of living can support themselves, their families and ensure their family’s economic future. Cuckoobag is therefore part of a movement to build working communities with the aim of facilitating longevity of employment and economic sustainability for the people and the products manufactured.

Consequently Cuckoobag works closely with the ‘For Millions Campaign’. This initiative was established to offer micro financing to the communities who manufacture the products to assist them in improving their current working conditions. To achieve their aims Cuckoobag will reinvest 2% of their annual profit in the working communities identified as needing support. This will be used in a variety of ways to ensure that the conditions within which the communities live can be improved for example ensuring that health services and education, become accessible to more people to improve their quality of life.

Cuckoobag is a UK company and has developed the Pop up Shop as a vehicle to sell and market its products to the consumer. It is hoped that some of these Pop up Shops will used as a method of aiding those groups and individuals enter employment and overcome various employment barriers they have experienced in the past. In the UK the ‘For Millions campaign’ will be geared to assist such workers by micro financing the start up of their business and providing levels of support and supervision to encourage their economic success.

Our supply chain is fundamental to Cuckoobag as we have well established links between every aspect of production.

Our Environmental Policy

  • We make every attempt to minimise the use of paper in the office i.e. through using internet based communications and making it common practice to not print documents unless absolutely necessary.
  • We raise awareness, encourage participation and train our staff in environmental best practice i.e. turning off lights and heating when not necessary, minimising and recycling waste,
  • Ensure that we work with suppliers that demonstrate good environmental management and suggest improvements to minimise packaging.
  • Seek to use the most eco-friendly transportation for our bags i.e. consolidate orders into full container shipments.
  • Agree to undertake a carbon footprint calculation annually and to put into place actions to reduce the company’s carbon footprint.

Delivery Policy

All deliveries are made by our courier. Deliveries are made between 8:30am - 6:00pm. It is essential that your order is consigned to a 'manned' address, where our courier can obtain a signature on delivery. If the courier is unable to make the delivery to the specified address and has to return at a later date, a supplementary charge may have to be made. We are unable to give ETAs on deliveries until after 3pm on the expected delivery date.
